These Terms of Service govern your use of Momento Video Alarm and the Momento mobile application. By using Momento, you agree to these terms.

1. About Momento

Momento is an alarm application that allows users to create alarms and receive personalized video messages from friends and family.

Momento is operated as an independent product. The application and its services may be updated, modified, suspended, or discontinued as development continues.

2. Eligibility

You may use Momento only if you are legally permitted to enter into these Terms in your jurisdiction.

If you are using Momento on behalf of another person or organization, you represent that you have the authority to accept these Terms on their behalf.

3. Your Account

Some Momento features require an account. You are responsible for maintaining the security of your account and for activity that occurs through it.

You agree to provide accurate information when creating or using your account and to notify Momento if you believe your account has been accessed without your authorization.

4. User Content

Momento allows users to upload and share video messages with other users. These videos and other materials submitted through the service are referred to as "User Content."

You retain ownership of User Content that you create and upload. By uploading User Content to Momento, you grant Momento the limited rights necessary to store, process, transmit, and display that content in order to provide the service to you and its intended recipients.

This permission does not give Momento ownership of your User Content.

5. Your Responsibility for User Content

You are responsible for the content you upload or send through Momento.

You must have the necessary rights and permissions to upload and share any video, image, audio, text, or other material you submit.

You may not use Momento to upload or distribute content that:

• Violates applicable laws or regulations.
• Infringes another person's copyright, trademark, privacy, publicity, or other rights.
• Contains sexual abuse material involving minors, child sexual abuse material, or other exploitative material involving minors.
• Threatens, harasses, or intentionally abuses another person.
• Contains malware or other material intended to damage or interfere with devices or services.
• Impersonates another person in a deceptive or harmful manner.
• Is otherwise intended to misuse or interfere with Momento or its users.

6. Content Moderation and Removal

Momento may remove, restrict, or disable access to User Content when we reasonably believe it violates these Terms, applicable law, or the safety of our users.

We may also suspend or terminate accounts associated with serious or repeated violations.

If you encounter content that you believe violates these Terms or applicable law, please contact us using the contact information provided through the Momento service.

7. Copyright Complaints

If you believe content available through Momento infringes your copyright, you may contact us with information describing the copyrighted work, the allegedly infringing material, and information sufficient for us to evaluate the complaint.

We may remove content that we determine is reasonably alleged to infringe another person's rights.

8. Privacy

Your use of Momento is also subject to our Privacy Policy, which explains how information is collected, used, and protected.

9. Third-Party Services

Momento may rely on third-party services to provide certain functionality, including authentication, hosting, storage, notifications, analytics, and distribution through app stores.

Your use of third-party services may also be subject to those providers' terms and policies.

10. Availability and Changes

We work to keep Momento available and functioning as intended, but we cannot guarantee that the service will always be available, uninterrupted, or error-free.

Features may be changed, added, or removed over time. We may also temporarily suspend portions of the service for maintenance, security, updates, or other reasons.

11. Disclaimer

Momento is provided on an "as is" and "as available" basis to the extent permitted by applicable law.

We do not guarantee that Momento will meet every individual requirement or that alarms, notifications, video playback, or other features will function in every circumstance or on every device.

In particular, Momento should not be relied upon as the sole means of receiving an alert where missing that alert could result in personal injury, property damage, financial loss, or another serious consequence.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Momento and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the service.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.

13. Termination

You may stop using Momento at any time.

We may suspend or terminate access to Momento when reasonably necessary, including when an account violates these Terms, creates a security risk, or is used in a manner that could harm the service or other users.

14. Changes to These Terms

These Terms may be updated from time to time. When material changes are made, we may provide notice through the application, website, or another appropriate method.

Your continued use of Momento after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

15. Governing Law

These Terms are governed by the laws applicable in the jurisdiction in which Momento is operated, without regard to conflict-of-law principles, except where applicable law requires otherwise.
